The proximity of a turbine or wind farm can have a detrimental effect on the landscape character of a locality. You are unlikely to see turbines within a designated Area of Outstanding Natural Beauty, although it is not impossible, because they can be seen as injurious to the amenity value. Why therefore should it be any different when looking at properties in other picturesque locations? We have experience in dealing with claims for the decrease in value of property resulting from the erection of wind turbines. We can also provide impartial advice in situations whereby an unsuspecting party has purchased property and subsequently turbines have been erected in close proximity.
The erection of a turbine or other form of disturbance close to a property may constitute a nuisance. The granting of planning permission does not in itself grant immunity from nuisance actions, therefore although you may have been granted permission, it does not mean that your neighbour has no rights, especially if the permission results in an actionable nuisance. This aspect should be carefully considered and one should not totally rely on the planning process to avoid future claims from neighbours.
The issue of shadow flicker is talked about widely in respect to wind turbines, but often is not well explained. We can discuss your concerns and provide advice based on your specific circumstances.
A more common nuisance relates to the noise produced from an operating apparatus that is considered to be interrupting the quiet enjoyment of a property. A direct correlation must be established between the construction of the said apparatus and a change in the character of the neighbourhood. There may also be grounds for compensation during the works phase of a project if the methods of construction create disturbance in terms of noise, pollution or dust.
